"Finnish Broadcasting Company has decided to suspend this procurement procedure. \n\nAccording to Finnish Act on Public Procurement and Concession Contracts (1397\/2016), section 125, a procurement procedure may be suspended for a real and legitimate reason.\n\nIt has been accepted in legal praxis to suspend the procedure if circumstances regarding the procurement have changed during the procurement procedure. However, it has also been noted that the contracting entity\u2019s right to suspend the procedure does not require exceptional circumstances to prevail (see e.g. the following decisions of the Supreme Administrative Court of Finland: KHO 2015 T 861, KHO 2015 T 875, KHO T 1639).\n\nIt is especially noted that the law does not require the contracting entity to execute the procurement if it emerges during the procedure that there are no rationale for the procurement (see the decision of the Market Court MAO 746\/15). The contracting entity\u2019s own discretion with regard to assessing rationale for the procurement has thus been given significant weight. \n\nThe Broadcast operating environment has changed during the procurement process and requires new approaches and combinations of capabilities. Also the need and criticality for support function requirements has changed during the the procurement procedure at hand. Consequently, after having reviewed the overall need for the procurement and recognizing that by its nature the 2nd level support function is strategically dealing with core functions and should thus be handled by Yle itself, Yle has decided to suspend the procedure. \n\nThe procurement procedure shall not be initiated again by Yle. Accordingly, the decision to suspend the procurement procedure may not be deemed to discriminate the tenderers. \n\n\nOn the grounds of above-mentioned legitimate basis for suspending the procurement procedure prevails.\n\nThe procurement unit has decided that 2nd level support, development and maintenance shall be organized by itself. \n\nYle suspends the procurement procedure. The tenders received by Yle shall be held confidential. \n"
